CONDICIONES GENERALES DE VENTA DE ENTRADAS Y ACCESO AL FESTIVAL DE LA LAVANDA

Condiciones Generales de uso y compra

Estas Condiciones serán efectivas a partir del día 1 de marzo de 2023. El contenido de estas Condiciones de uso es el siguiente:

1.- Scope of application of these conditions

This site (hereinafter, the “Site”) is owned and operated by the ASOCIACIÓN CULTURAL DE LA LAVANDA (the "Association"), a Spanish association with registered office at Barrionuevo Bajo, 30 19400 Brihuega Guadalajara with CIF: G09880196 . 1.1.- Acceptance of the conditions

Las Condiciones Particulares se mostrarán en la sección apropiada del Sitio y si utilizas los Servicios sometidos a las mismas, se entenderá que, además de aceptar estas Condiciones aceptas las correspondientes Condiciones Particulares.

DADO TODO ESTO, POR FAVOR LEE ATENTAMENTE ESTAS CONDICIONES DE USO, DADO QUE CONTIENEN INFORMACIÓN IMPORTANTE ACERCA DE TUS DERECHOS, LOS MEDIOS PARA HACERLOS VALER Y TUS OBLIGACIONES.

1.3.- Requirements to access the Service

These Conditions (in combination, where applicable, with the corresponding Specific Conditions) constitute the entire agreement that the Association has with you in relation to the Service, and supersede all previous agreements between you and the Association in relation to the Service. 2.- Object: Content and services of the website

En la correspondiente ficha de cada Evento figurarán el/los artistas principales que actúen en el mismo, sus características esenciales, su fecha y horario. Podrás además acceder al precio para cada tipo de Entrada con el correspondiente IVA desglosado y especificando qué parte aplica al precio de la Entrada, propiamente dicha (Entrada que es vendida por el Festival de la Lavanda) y qué parte aplica a los gastos o recargo de distribución de la misma (que compensan los Servicios prestados por la Asociación). En este sentido, la adquisición de entradas a través del Sitio implica el abono de un gasto de gestión o distribución por cada entrada, tasa de transacción por cada pedido y/o cualquier otra tasa suplementaria que resulte de aplicación para el Evento. Dichos gastos y tasas no son reembolsables. Los precios están expresados en Euros. En el caso de que se produzca un error manifiesto en el precio que aparezca en la ficha de servicio, prevalecerá el precio establecido para dicho servicio en el email informativo que se proporcionará cuando se detecte el error.

2.3.- Conditions of Tickets and access to the Event

Para acceder al recinto donde se celebre el Evento todo usuario deberá tener su correspondiente Entrada. El Festival de la Lavanda no garantiza la autenticidad de la entrada si no ha sido adquirido en los puntos de venta oficiales. Las entradas no son nominativas, es decir, que puede hacer uso de ellas una persona diferente a la que aparece en el documento que facilita el acceso al recinto. No es necesario que aparezca el nombre del titular en la entrada. Cada Entrada da derecho a acceder al concierto o Evento para el que se haya adquirido, teniendo que coincidir la fecha y el artista indicados en el ticket para que esta sea válida y permita el acceso del usuario al recinto. Se instalará un control de accesos en la entrada del recinto que permitirá detectar entradas duplicadas y falsas. El coste de utilizar este Sitio y su conexión con el control de entradas se refleja en el recargo de distribución que pagarás a la Asociación al adquirir la Entrada. Debes conservar tu entrada hasta la finalización del Evento y el Festival de la Lavanda podrá exigirte que la exhibas para tramitar cualquier reclamación que presentes.

If this condition is breached, the Promoter will have the right to cancel the Tickets without prior notice, refund, compensation or any other liability. The Association and the Lavender Festival are not responsible for any incidents related to the Tickets themselves if they have not been purchased at an official point of sale. REMEMBER THAT RESELLING TICKETS MAY INVOLVE A VIOLATION OF THE APPLICABLE LAW AND THEY MAY BE CONFISCATED. You assume full responsibility if the entry shows signs of falsification, duplication, breakage or tampering. The Lavender Festival reserves the right to deny access to the holder of illegible, false, duplicate or illicitly acquired tickets, without the buyer having any right to compensation or compensation for this. En ningún caso se denegará el acceso por razones de nacimiento, raza, sexo, religión, opinión, discapacidad, orientación sexual, identidad de género o cualquier otra circunstancia o condición personal o social.

No se permite entrar al recinto con:

• Cascos de moto, maletas, bolsas o mochilas de grandes dimensiones
• Bebidas o alimentos en envases de metal, vidrio, cerámica, madera, o materiales similares que puedan ser utilizados como proyectiles
• Envases congelados que puedan resultar objeto contundente
• Pancartas y/o banderas que inciten a la violencia
• Colonias con envase de cristal o metálico
• Cualquier clase de bebidas alcohólicas, así como estupefacientes, psicotrópicos, estimulantes, o sustancias análogas
• Palos selfie, paraguas, drones y punteros láser
• Nevera o bolsa con varios productos de alimentación
• Grabadoras de audio, de video y/o cámaras réflex, sin espejo y cualesquiera que permita lentes intercambiables.
• Armas de cualquier clase o cualesquiera objetos que pudieran ser usados como tales o artefactos peligrosos para la integridad física de las personas, así como petardos, cohetes y toda clase de artículos pirotécnicos que puedan producir ruidos o incendios.

Siguiendo las recomendaciones sanitarias y debido a que no podemos conocer la procedencia y garantizar la desinfección de cada alimento procedente del exterior, no está permitida la entrada al recinto con comida ni bebida. Además, y con el objeto de contribuir a garantizar la seguridad de los asistentes, el personal de seguridad privada del festival podrá efectuar, entre otras actuaciones, controles de identidad o de objetos personales en el acceso o en el interior del recinto.

La organización podrá denegar el acceso o expulsar del recinto al usuario que incumpla estas condiciones o las instrucciones impartidas por el personal del Festival de la Lavanda, así como en caso de que pueda racionalmente presumirse que va a implicar una situación de riesgo o peligro para el propio usuario u otros asistentes, por alboroto o por estados de intoxicación aparente o potencial, responsabilizándose personalmente el usuario en todos los casos con sus propias acciones y omisiones que causen lesiones a terceros o daños a las cosas.La Asociación y el Festival de la Lavanda no poseen ninguna clase de responsabilidad por cualquier posible daño o pérdida de ninguna clase que tenga lugar en un evento o en conexión con el mismo (incluyendo pérdida, daño, hurto o robo sobre cualquier propiedad personal durante un evento).

2.4.- Access for minors and people with reduced mobility:

Only minors under 16 years of age may enter the venue if they are accompanied by a responsible adult (father, mother or legal guardian). Minors under 5 years of age can enter without a ticket, as long as they do not occupy any numbered seats. This adult may accompany several minors as long as he or she is responsible for all of them. We recommend that, at most, each adult be responsible for three minors. At the end of the Event, minors cannot remain in the venue.

To certify the age of the minor, it will be mandatory that both the minor and his parents carry the corresponding identification documents and proof of the minor's authority and show them along with the tickets.

Se considera Persona de Movilidad Reducida a toda aquella persona que tenga un grado de discapacidad reconocido igual o superior a un 33%, ya sea física, cognitiva, intelectual o sensorial. Para certificar, será preceptivo enseñar la correspondiente tarjeta en la puerta del recinto junto con la entrada. Cumpliendo la normativa vigente, El FESTIVAL DE LA LAVANDA cuenta con un 1% del aforo reservado para personas de movilidad reducida, y solamente se permite un acompañante para que, de esa forma, haya más espacio para personas de movilidad reducida que puedan comprar su ticket. El festival cuenta con espacio reservado para personas de Movilidad Reducida. Las localidades para esta zona se venden con la denominación “Movilidad reducida” y “Acompañante movilidad reducida” y se encuentran debidamente señalizadas en el recinto.

2.5.- Recordings of the Event and advertising uses

La posesión de la Entrada no da derecho a su poseedor o a terceros a utilizar la misma o su contenido con fines publicitarios, de marketing o de promoción (incluidos concursos, regalos y/o sorteos) asociados al poseedor de la entrada o terceros. Estas actividades serán perseguidas con el fin de establecer la responsabilidad pertinente. Todos los derechos propiedad intelectual, industrial y cualesquiera otros, incluidos los de imagen, derivados, directa o indirectamente, de las representaciones artísticas o cualesquiera otras que tuvieran lugar con motivo de la celebración del Festival quedan reservados a sus respectivos titulares, sin limitación territorial ni temporal, y sin ninguna otra limitación más que las dispuestas en la vigente Ley de Propiedad Intelectual. En consecuencia, queda terminantemente prohibida la captación, fijación o grabación de imágenes o sonidos sin la previa autorización escrita de la Organización. La Organización podrá expulsar a cualquier persona que incumpla la anterior obligación sin que ello genere derecho alguno de devolución del importe de la entrada abonada.

El público asistente al festival podrá aparecer en imágenes tomadas por diferentes medios para su posterior difusión a través de cualquier medio. El público asistente al evento autoriza expresamente y a título gratuito la captación y fijación de su imagen, voz y nombre con la finalidad de permitir la máxima explotación de las grabaciones que puedan realizarse durante la celebración del Festival y su posterior difusión por el Festival de la Lavanda o terceros autorizados por ésta a través de cualesquiera medios de comunicación, sin limitación territorial ni temporal; y consintiendo expresamente un uso promocional y/o comercial de las imágenes captadas. A estos efectos, cedes al Festival de la Lavanda, a título gratuito, el contenido patrimonial del derecho a tu propia imagen contenido en este tipo de imágenes o grabaciones, sin limitación temporal y espacial, para su explotación en cualquier medio o mediante cualquier forma de comunicación, incluido su nombre en cualquier tipo de publicidad, promoción, publicación (incluido Internet), o cualquier otro medio, incluso con fines promocionales o informativos, así como su exhibición en cualquier medio y/o soporte. En ningún podrás reclamar cantidad económica alguna derivada de la explotación que de dichas imágenes se pudiera llevar a cabo.

3.- Procedimiento de compra, formas de pago y entrega de las entradas

3.1.- Purchase procedure

Buying tickets for the Lavender Festival is very easy.

In any case, we also have a box office at the venue so you can purchase your tickets physically, but this will be available exclusively from the first day the concerts start, from the time the doors open and most likely by then. To proceed with the purchase of Tickets through the Site, it can be done through a registered user or without registration. To register, press the “register” button enabled on the Site and fill in the information we request. This way you will not have to fill in your information again with each purchase. To access as a registered user you must identify yourself by email and password.

To purchase Tickets through the Site, you must select the desired Event (if applicable, if it is repeated, its date), the location of the seats, which in this case will be shown on the screen, number of tickets and rate. Antes de confirmar la compra, deberás introducir tu nombre y apellidos, email y opcionalmente tu código postal y móvil, además deberás aceptar estas Condiciones marcando con un tick la casilla que a tales efectos se dispone en el formulario, en la que se indica la aceptación de estas Condiciones y la Política de Privacidad sobre el tratamiento de tus datos. Si no aceptas tanto estas Condiciones como la Política de Privacidad (esta última a efectos de garantizar que la has leído y entendido) no se podrá finalizar el proceso de compra. Además, de lo anterior, se pedirá tu consentimiento para cualquier tratamiento de datos así lo requiera, consentimiento éste que podrás o no otorgar a tu entera elección, sin que ello te impida adquirir Entradas.

Posteriormente aparecerá en pantalla un resumen de la compra incluyendo el precio total final. Antes de pasar a la pasarela de pago, deberás seleccionar el método de pago (tarjeta debito/crédito) y pulsar en el botón “PAGAR”.

Una vez confirmado el proceso de compra de los Servicios/productos aparecerá en pantalla la pasarela de pago, en la cual se solicitarán los campos que deberás rellenar para efectuar el pago de las entradas seleccionadas.

En caso de que el método de pago seleccionado sea tarjeta de crédito o débito deberás introducir el número de tarjeta, la fecha de caducidad y el código CVV de la misma y confirmar el pago. Una vez el pulses, “Pagar” aparecerá una pantalla de confirmación del pago.

ATENCIÓN: Si has equivocado la introducción de cualquier dato, de la misma pantalla en la que estés, podrás borrarlo introducir el dato correcto. Si la equivocación está en alguna pantalla anterior, deberás comenzar de nuevo el proceso de compra pulsando para ello el botón que te permite deshacer la acción.

Si el proceso de compra se completa correctamente, la compra se confirmará en pantalla, facilitando el número de referencia de la misma. El número de referencia identifica de manera única la compra que hayas efectuado y es la forma que tiene el personal de Noches del Botánico para identificar tu compra en caso de que quisieras hacernos alguna consulta.

Adicionalmente, recibirás en tu dirección de correo electrónico un email de confirmación de compra, detallando las especificidades de la misma junto con un enlace a estas Condiciones. Salvo que se indique lo contrario en dicho email o en las presentes Condiciones, el email de confirmación de compra no podrá ser utilizado como entrada para acceder al evento. Las entradas sólo podrán ser descargadas desde la pantalla de confirmación y/o desde el email de confirmación de compra. El Festival de la Lavanda no se hace responsable de que no recibas el email de confirmación de pedido por no haber escrito correctamente tu dirección de correo electrónico.

Si adquieres las entradas mediante Usuario registrado podrás consultar el historial y/o el estado de las entradas adquiridas, modificar tus datos personales de registro, así como su contraseña de acceso y contactar con el servicio de atención al cliente del Sitio, entre otras acciones.

Antes de finalizar tu compra o reserva, lee con detenimiento toda la información relacionada con el Evento y/o la Entrada. En caso de que tú o cualquier miembro de tu grupo tenga necesidades especiales, te rogamos lo comuniques en el momento de realizar la reserva e intentaremos cumplir con los requerimientos oportunos. No podemos garantizar que se puedan cumplir éstos si la notificación no se realiza con suficiente antelación.

CADA VEZ QUE INICIAS EL PROCESO DE COMPRA DE PRODUCTOS/SERVICIOS, NOS GARANTIZAS QUE: A) ES LEGALMENTE CAPAZ DE CELEBRAR UN CONTRATO DE COMPRAVENTA Y B) TIENES DERECHO Y ESTÁS FACULTADO PARA UTILIZAR EL MEDIO DE PAGO ESTABLECIDO.

3.2- Forma de pago 

The Association accepts credit and debit cards (Visa, MasterCard), and, in general, all forms of payment that are shown or evidenced on the payment page referred to in the previous Condition 3.1.

All payment details are processed through a secure sales banking platform. Through this payment method, the Lavender Festival never collects or manipulates any data related to your card number. All data is processed directly by the Association through its payment gateway and for the sole purposes of said payments.

3.3. - Ticket delivery:

You will receive, along with the purchase confirmation email, a link to download the Tickets. Tickets can only be downloaded from the confirmation screen and/or from the purchase confirmation email. The Lavender Festival is not responsible if you do not receive the order confirmation email due to not entering your email address correctly. Each purchase is associated with a print at home, which allows you to print the Ticket as many times as you want.

En general, el acceso electrónico a las Entradas se enviará cuanto antes y, en todo caso, en el plazo máximo de entrega (treinta días desde la compra o, si es antes, con al menos cinco días de antelación al Evento). Sólo en aquellos casos en que así se haga constar en la ficha del Evento, el enlace para las Entradas se enviará no al efectuar su compra sino con los días de antelación al Evento que se indiquen.

Comprueba por favor siempre tus Entradas en el momento en que las recibas e infórmanos sin demora sobre cualquier posible error que se pudiese haber producido. Los errores que hayas tenido al realizar la compra no siempre pueden ser corregidos y cualquier corrección de éstos se realizará únicamente en la medida en que la Asociación y/o el Promotor lo consideren razonable.

4.- Obligations of the parties regarding the Services
